• Email campaign tracking (opens, clicks, bounces) via webhooks

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain and update your account information
• Have the legal authority to bind yourself to these Terms

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials

4. Social Media Account Connection

• You have the right to grant us read access to your account data
• You will not connect accounts that violate platform policies

4.3 Revocation

You may revoke our access to your social media accounts at any time through:

• Your social media platform's authorised apps settings
• Contacting our support team

5. Outreach and Email Campaigns

5.1 Email Outreach

Our platform allows you to send outreach emails to creators and brands. By using this feature, you:

• Accept full responsibility for the content of emails sent through our Service
• Agree to comply with all applicable anti-spam laws (CAN-SPAM, GDPR, etc.)
• Will not use the outreach feature for unsolicited bulk email or spam
• Acknowledge that emails are delivered via Mailgun and subject to their acceptable use policy
• Understand that email tracking (opens, clicks) is enabled by default for campaign analytics

5.2 Creator Discovery

Our viral creator discovery feature uses publicly available data from platform APIs. You agree to:

• Use discovered creator information for legitimate business outreach only
• Respect creators' privacy and communication preferences
• Not use the feature for harassment, stalking, or any malicious purpose

6. User Responsibilities and Conduct

6.1 Acceptable Use

You agree NOT to use the Service to:

• Violate any laws, regulations, or third-party rights
• Send spam, phishing emails, or fraudulent outreach
• Impersonate others or misrepresent your identity in outreach campaigns
• Distribute malware, viruses, or harmful code
• Circumvent platform rate limits or API restrictions
• Scrape or harvest data beyond what is provided through our Service
• Interfere with the Service's operation or security
• Use AI-generated strategies or insights to mislead or deceive audiences

6.2 Platform Compliance

You must comply with all terms of service and policies of:

• YouTube (Google) Terms of Service and API Services Terms
• TikTok Terms of Service and Developer Terms
• Instagram/Meta Terms of Service and Platform Policy
• Mailgun Acceptable Use Policy (for outreach emails)

7. AI-Generated Content and Strategies

Our Service uses Google Gemini to generate content strategies, opportunity insights, and outreach email drafts. You acknowledge that:

• AI-generated strategies are recommendations, not guarantees of performance
• You are responsible for reviewing and approving all AI-generated outreach emails before sending
• AI outputs may occasionally contain inaccuracies and should be verified
• We do not guarantee specific results, growth, or engagement from following AI strategies

8. Intellectual Property Rights

8.1 Your Data

You retain all ownership rights to your social media data and content. By using the Service, you grant us a limited, non-exclusive, worldwide licence to:

• Access, analyse, and process your social media data for service delivery
• Generate insights, strategies, and recommendations based on your data
• Cache and store analytics data for performance optimisation

This licence terminates when you disconnect your accounts or delete your account.

8.2 Our Platform

3Rings and its original content, features, algorithms (including our virality scoring system), and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws.

9. Subscription and Payment

9.1 Fees

Access to certain features may require a paid subscription. Payments are processed securely via Stripe. You agree to:

• Pay all applicable fees as described in your plan
• Provide accurate billing information
• Authorise recurring charges for subscription plans
• Pay any applicable taxes

9.2 Cancellation and Refunds

You may cancel your subscription at any time. Refunds are provided according to our refund policy. No refunds are given for partial subscription periods unless required by law.

10. Service Availability and Modifications

• Delivery of all outreach emails (subject to Mailgun and recipient server policies)

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service
• Update features, pricing, or functionality
• Impose limits on usage or features
• Change these Terms with notice to users

11. Third-Party Services and APIs

Our Service integrates with third-party platforms and services. We are not responsible for:

• Changes to YouTube, Instagram, or TikTok APIs or policies that affect our Service
• Service interruptions caused by third-party platforms
• Account restrictions imposed by social media platforms
• Email delivery failures caused by Mailgun or recipient mail servers
• Changes to Google Gemini AI capabilities that affect strategy quality

You acknowledge that third-party platform changes may affect Service functionality and that we will make reasonable efforts to adapt.

12. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Damages exceeding the amount paid to us in the past 12 months

13. Indemnification

You agree to indemnify, defend, and hold harmless 3Rings and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Outreach emails or communications sent through the Service
• Your social media account activities
• Violation of anti-spam laws through our outreach features

14. Termination

14.1 By You

You may terminate your account at any time through your account settings or by contacting support.

14.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms or applicable laws
• Use outreach features for spam or harassment
• Engage in fraudulent or harmful activities
• Fail to pay applicable fees
• Pose a security or legal risk

14.3 Effect of Termination

Upon termination:

• Your access to the Service will cease immediately
• Social media account connections will be revoked
• Cached insights and strategy data will be purged
• Your data will be deleted according to our Privacy Policy
• Outstanding fees remain due and payable

15. Dispute Resolution

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
